Welcome to Refurbito, a price-comparison portal for refurbished electronics operated by Daniel Samer. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Daniel Samer ("we", "us", or "our") governing your access to and use of our website and services.

Refurbito compares prices, condition grades, and warranty terms for refurbished smartphones, laptops, and tablets across multiple retailers, including Refurbed, Back Market, and Rebuy. We also participate in affiliate programs, both from refurbished-electronics retailers and the Amazon Associates Program, which allows us to earn commissions through referred purchases.

By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use our services.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the platform after such changes constitutes acceptance of the modified Terms.

To use our services, you must:

- The price you pay is not affected by using our affiliate links

- Condition grades such as "Like new", "Very good", or "Good" are not standardized and are defined independently by each retailer
- Statutory warranty and voluntary manufacturer guarantees differ by retailer and device; you will find the terms with the respective provider
- Product reviews and comparison verdicts reflect our opinion based on publicly available information
- Individual experiences with a used device may differ from our assessments

If user interactions are enabled, we encourage you to exercise caution and common sense. Report suspicious or inappropriate behavior to us immediately.

We reserve the right, but have no obligation, to monitor user activity and take action we deem appropriate, including removing content or suspending accounts.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR PERFORMANCE.

We do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, BUSINESS, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR 100 EUR, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Daniel Samer and all affiliates, officers, agents, partners, and employees from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

- Your use of and access to the platform
- Your violation of any provision of these Terms
- Your violation of third-party rights, including intellectual property, privacy, or publicity rights
- Content you submit or transmit through the platform
- Damages caused by your negligence or willful misconduct

This indemnification obligation survives the termination of these Terms and your use of the platform.

You may terminate your account at any time by following the instructions in your account settings or by contacting us.

We reserve the right to suspend or terminate your account and access to the platform at our sole discretion, without prior notice, if we believe your conduct:

- Violates these Terms
- Harms other users or third parties
- Is fraudulent or illegal
- Is otherwise objectionable

Upon termination:
- Your right to use the platform ceases immediately
- We may delete your account and content
- Provisions intended to survive termination remain in effect

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law provisions.

Disputes arising from or relating to these Terms or the platform will be resolved as follows:

1. Informal Resolution: Before filing a formal complaint, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

2. Venue: If informal resolution fails, legal proceedings will be brought before the courts having jurisdiction at the operator's registered seat in Germany, to the extent permitted by law.

3. Class Action Waiver: You agree to resolve disputes on an individual basis only and waive any right to participate in class actions.

Nothing in this section limits your rights under applicable consumer protection law.
